A Resolution Establishing Miscellaneous Rules And Regulations.


BE IT RESOLVED by the Board of Directors of the North Kootenai Water District, that;





This Resolution shall be known, and shall be cited, as the Miscellaneous Rules and Regulations Resolution.





Separate parcels of land shall each be supplied with water by its own water service.† A parcel of land shall be as determined by the Kootenai County Assessor.† If a single user or enterprise uses more than one parcel of land in a contiguous manner, and for a single purpose, the District Manager may determine that only one water service will be required.





Water service will only be provided to those properties that abut a water main of adequate size.† The District Manager shall determine the adequacy of water mains and where new services will be located.





North Kootenai Water District shall only be responsible for maintenance and repair of water services from the water main up to and including the water meter.† Each user shall provide an accessible shut-off valve at or near the downstream side of the water meter box.† North Kootenai Water District shall not be responsible for maintenance or repairs downstream of the water meter.


Private irrigation system connections shall be on the downstream side and outside of the water meter box




New residential subdivisions and commercial properties over one acre must be annexed into North Kootenai Water District before being provided regular water service.† The cost of such annexation shall be paid by the property owner.





Connection to the North Kootenai Water District water system constitutes an authorization for District personnel to enter upon private property at reasonable times and places for the purpose of reading water meters, and, with reasonable notice for the purpose of repairing, inspecting, replacing, or removing water meters and other District facilities that may be located thereon, or for terminating water service.

No person shall construct or place upon or about any water meter box, fire hydrant, water valve, or any other District facility any barrier, building, vehicle, planting, fencing or other objects so as to conceal, obscure or cover, or in any other manner prevent free access, or in any way to hinder, delay or obstruct District personnel from reading or servicing said facilities.


Failure of the owner or occupant to remove any such obstruction after 10 days written notice constitutes authorization for the District to enter upon the private property to remove such obstruction and to charge the cost of that removal to the owner and occupant of the property, to be paid along with other water charges and/or to terminate water service to the affected property, as deemed appropriate in the sole discretion of the District.





An extension of the water system required to provide water service to a parcel of land shall be designed and constructed at the sole expense of the owner of the property requiring water service, or his agent, and shall extend the existing water main along the entire property frontage.† The District Manager shall, after consulting with the District Engineer, determine the size of pipe and the route to be taken to properly serve the property.





Charges for use of water on a property are the responsibility of the property owner, or any subsequent property owner, and shall be paid in compliance with District rules, regulations, and applicable law.





A customerís water service may be discontinued after ten days written notice of violation of any provision of any North Kootenai Water District Resolution or Ordinance.† The customer may request in writing a hearing before the District Board of Directors at its next regular meeting prior to service being terminated.


This Resolution becomes effective upon passage and replaces all Resolutions, Ordinances, and Policies or portions thereof that are in conflict with this Resolution.
